The answer depends on your industry, the type of pass you are applying for, and whether your local workforce headcount meets the applicable quota. This guide explains the S Pass and Work Permit quota system for Singapore companies in 2026.
The Two-Tier Foreign Worker Framework
Singapore’s foreign worker policy is administered by the Ministry of Manpower (MOM) and uses two primary mechanisms to control the number of foreign workers a company can employ:
- Dependency Ratio Ceiling (DRC): limits the proportion of a company’s workforce that can be non-Singaporean/non-PR workers
- S Pass Sub-Quota: within the DRC, limits the proportion that can hold S Passes specifically
Employment Pass (EP) holders are not counted under the DRC or S Pass sub-quota. EP holders are mid-to-senior professionals whose passes are assessed on individual merit (qualifications, salary, job relevance) rather than company headcount ratios.

How to Calculate How Many S Pass Holders You Can Hire
The S Pass sub-quota is calculated based on your total workforce â meaning all employees, both local (Singaporean and PR) and foreign. Here is a worked example for a services sector company:
- Total workforce: 20 employees
- S Pass sub-quota (services): 10% of 20 = 2 S Pass holders allowed
If you want to hire a third S Pass holder, you need to either grow your total workforce to 30 (10% of 30 = 3), or have the new hire qualify for an Employment Pass instead.
Note that S Pass holders themselves are counted in the total workforce for quota purposes. So as you hire more S Pass holders, your quota may increase incrementally â but only if you also hire local workers to maintain the ratio.
Work Permit Quotas
Work Permit holders (for lower-skilled workers, mainly in construction, manufacturing, and services) are governed by the same DRC framework. For the services sector, up to 35% of the total workforce can be Work Permit holders (inclusive of the S Pass sub-quota).

- Construction: workers must come from approved source countries (mainly Malaysia, China, India, Bangladesh, Myanmar, Philippines, Sri Lanka, Thailand); the Man-Year Entitlement (MYE) system governs how many workers from non-traditional source countries a construction firm can hire
- Domestic workers: Foreign Domestic Workers (FDWs) are governed separately under the Foreign Domestic Worker scheme and do not count against the employer’s corporate DRC
- Services sector: stricter from 2024 onwards, with incremental reductions to the sub-quota for certain subsectors
The Fair Consideration Framework (FCF)
Beyond quotas, companies with 10 or more employees must comply with the Fair Consideration Framework when hiring for positions paying below S$20,000 per month. This requires:
- Advertising the position on the MyCareersFuture.sg portal for at least 14 calendar days before applying for an Employment Pass
- Considering all applications fairly regardless of nationality
- Maintaining documentary evidence of the hiring process
MOM actively monitors FCF compliance. Companies that show a pattern of hiring foreigners without fairly considering Singaporeans may be placed on the FCF watchlist, which restricts their ability to make new EP applications.
Levy Obligations for Work Permit and S Pass Holders

- If you are close to your S Pass quota, consider whether the next hire qualifies for an Employment Pass instead â EP has no quota but higher salary requirements
- Quota calculations use CPF-contributing employees. Part-time and contract workers may or may not count depending on their employment arrangement
- MOM has the discretion to reject applications even within quota if it has concerns about fair hiring practices
