An ACRA penalty notice needs an evidence check before the company decides how to respond. Match the entity and filing period, locate the accepted submission and identify the action stated in the notice. Do not dismiss it because someone remembers filing, or assume that a payment receipt proves the underlying return was accepted.

Identify the notice precisely

Record the company name, UEN, notice reference, issue date and response details. Give a director and the company secretary a copy through the approved channel. Distinguish a late lodgment penalty, a composition offer, a summons and a striking-off letter. They are different matters and should not share one generic tracker entry called ACRA fine.

Check the source through an official route rather than following unexpected payment instructions in a message. Preserve the envelope or email and its attachments. If the notice is unclear, ask the secretary to verify its meaning promptly.

Reconstruct the submission trail

Gather the filing instructions, approval, transaction reference, acknowledgement and current record. Record which financial period each document concerns. A receipt for last year’s return will not establish completion of this year’s filing. Likewise, an attempted upload or a prepared draft may explain activity without proving acceptance.

Example: payment exists but the return is unresolved

An administrator finds a bank debit labelled filing costs. The secretary should trace the actual transaction acknowledgement and check the relevant return. Keep the payment evidence, but leave the filing question open until it has been reconciled. Do not make a duplicate submission just to obtain a fresh receipt.

Assign the response and retain the outcome

ACRA’s late-return guidance distinguishes penalties and enforcement processes and provides an appeal route. Any appeal needs supporting evidence and does not guarantee a reduction. Ask the appropriate adviser about the actual notice and any required attendance or response. Legal assistance should come through advisers from associated law firms where needed.

Keep the accepted response or official outcome with the notice. A sent enquiry, an internal approval or an appeal acknowledgement is not proof that the matter has been resolved.
