Before answering the new ACRA CEO declaration, check who actually performs the chief executive role and whether the company records support the answer. ACRA’s annual-return guide flags the declaration as taking effect from 20 October 2026. Preparing the evidence now can prevent a last-minute query when the return is filed. A job title alone is not a reliable filing checklist.

What is changing, and when?
ACRA’s current annual-return walkthrough says that, from 20 October 2026, a company must indicate whether any individual performs the role of a CEO. Where the answer is yes, the person should be reflected as an appointed position holder. This guide is reviewed on 18 October, so that step is upcoming rather than already effective. Use the live form and current ACRA guidance when filing.
Build a short role-and-records pack
Ask the director responsible for the filing to identify the individual principally managing the business. Collect the appointment decision, acceptance or employment documents where relevant, a description of actual responsibilities, and the latest company particulars. Record any difference between the working title and the responsibilities. The purpose is to clarify the facts, not to create a fresh appointment merely to make the form look complete.
Resolve inconsistencies before submission
A founder may call herself CEO in customer presentations while the corporate file contains no explanation of that role. Conversely, an executive may perform the role under a different title. Give those facts to the company secretary for review. If an appointment or particulars update is needed, establish the genuine effective date and correct filing route. Do not invent an earlier date or backdate a resolution.
A practical review sequence
- Identify the person performing the role and the period concerned.
- Compare that information with appointment documents and current Bizfile particulars.
- List discrepancies and assign a director to answer each one.
- Complete any required updates before the annual-return declaration.
- Retain the approved answer and filing acknowledgement together.
Do not wait until the payment screen to ask who approved the declaration. An internal checklist should distinguish preparation, approval and successful filing.
What should the director receive?
Keep the role confirmation, supporting documents, any update receipt and the completed annual-return record in the same indexed folder. If uncertainty remains over whether a person falls within the statutory role, obtain advice before making the declaration. This preparation does not change the company’s annual-return due date or replace other filing checks.
